Agreement
These Terms of Use govern your use of BidMeasure and its related support and marketing pages. By downloading, purchasing, or using BidMeasure, you agree to these terms and Apple’s applicable App Store terms. If you do not agree, do not use the app.
License and acceptable use
Subject to these terms, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use BidMeasure on Apple devices you own or control, as permitted by App Store rules. You may not copy, resell, reverse engineer, bypass access controls, interfere with the app, use it unlawfully, or misrepresent its output.
Construction and estimating disclaimer
BidMeasure is an estimating and calculation aid, not engineering, architectural, surveying, legal, code-compliance, safety, or financial advice. Results depend on your inputs and assumptions. Before bidding, purchasing, cutting, fabricating, or building, independently verify measurements, plans, loads, specifications, prices, waste, units, rounding, field conditions, permits, and applicable codes with qualified professionals and authoritative sources.
You are responsible for decisions, bids, contracts, orders, work, and safety. Do not rely on BidMeasure as the sole basis for a safety-critical or high-value decision.
Subscriptions and purchases
Available products, prices, trial or introductory offers, billing periods, and feature access are displayed in the app before purchase. Payment is charged to your Apple account. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period, subject to Apple’s then-current rules. Apple manages billing, renewal, cancellation, refunds, and payment methods.
You can manage subscriptions in your Apple account settings and restore eligible purchases from the app. Deleting the app does not cancel a subscription. Where applicable, unused portions of a free trial may be forfeited when a subscription is purchased.
Your content
You retain responsibility for project details, client information, photos, files, estimates, reports, and other content you enter or import. You represent that you have permission to use and share that content. Keep independent backups of important records; app deletion, device loss, storage limits, or software errors may cause data loss.
Third-party services
BidMeasure may rely on Apple services such as the App Store, StoreKit, iCloud, maps, photo selection, document handling, and sharing. Those services are governed by their providers’ terms and availability. We are not responsible for third-party outages, policies, or content.
Updates and availability
We may change, add, suspend, or discontinue features; release updates; or require a supported system version. We do not guarantee uninterrupted, error-free, or permanently available operation.
Intellectual property
BidMeasure, its interface, branding, software, and original content are owned by us or our licensors and are protected by applicable intellectual-property laws. These terms do not transfer ownership to you.
Disclaimer of warranties
To the maximum extent permitted by law, BidMeasure is provided “as is” and “as available,” without warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, availability, or error-free operation. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, incorrect bids, material shortages or overages, rework, delay, property damage, injury, or claims arising from use of or inability to use BidMeasure. Our total liability for claims relating to the app will not exceed the amount you paid for BidMeasure during the 12 months before the event giving rise to the claim, unless applicable law requires otherwise.
Termination
These terms remain effective until terminated. Your rights end if you materially violate them. Provisions that by their nature should survive termination—including ownership, disclaimers, limitations, and dispute-related terms—will survive.
Changes and severability
We may update these terms and will publish the revised date. Continued use after an update means you accept the revised terms. If a provision is unenforceable, the remaining provisions stay in effect. Failure to enforce a provision is not a waiver.
